Let our attorneys answer your rental property questions.

Tenant Representation/Tenant Rights

Attorney Brian A. Schuk represents tenants through Walworth, Waukesha, Kenosha and Racine County, including the Delavan, Elkhorn, Lake Geneva, whitewater, New Berlin, Brookfield and Muskego areas, protecting their rights and collecting unreturned security deposits since 2001.

Reasons for Representation

  • My landlord did not return my security deposit.
  • My landlord only returned part of my security deposit.
  • My landlord took longer than 21 days to return my security deposit.
  • My landlord has entered my residence without notice or less than 12 hours of notice.
  • My landlord is charging my security deposit for damage I did not do.
  • My landlord threatened to evict me.
  • My landlord is charging me a late fee.
  • My landlord has failed to repair my unit as promised.
  • My landlord is charging a different rent than was advertised.
  • My landlord locked me out of my residence.
If you have been affected by any of these issues, Attorney Brian A. Schuk may be able to assist you. Contact him at (262) 728-0700.

We also handle personal injury and discrimination cases for tenants.

Uninhabitable Living Conditions

If you are a tenant who wants out of a lease because of uninhabitable living conditions, our firm can help you. Living conditions that may be grounds for breach of contract include:
  • Building code violations
  • No hot water
  • Improper heating
  • Mold
  • Unsafe conditions
Your landlord is required to maintain the premises in a condition fit for human habitation.

Attorney Brian A. Schuk represents clients in agricultural, trade and consumer protection cases (ATCP). In these cases, we help tenants recover monetary loss because of zoning code and housing code violations. If you overpaid, spent money on repairs or were forced to spend time in a hotel, you may be eligible for compensation.

If you are a tenant who has vacated your rental property and have not received your security deposit back, or received it back more than 21 days after surrendering the premises, contact this office immediately, as you may be entitled to a doubled security deposit return.
